Why You Should Make A Will

Having a will is the only way to ensure that your estate is distributed to the people you would like to benefit from it.

 

By not having a will in place this can cause serious problems, financial difficulties and hardship for your loved ones left behind at the hardest time in their lives.

 

Making a will ensures your estate passes through Probate quickly.

 

Dying Intestate (without a will)

 

The Administration of Estates Act 1925 sets out who gets what in every situation where there is no will, there is nothing your family can do to overrule their decision. Under legal ‘Intestacy Rules’ your estate can only pass to spouse, certain blood relatives, or if there are none, it will go to treasury.

 

Without a Will, you cannot be sure those you would wish to benefit will actually do so. Your spouse/civil partner will not automatically inherit ALL of your estate. Minor children could be taken into care whilst Guardians are appointed. You cannot prevent certain family members from benefiting.

 

Updating A Will

 

During your lifetime, a lot of changes happen. You may move house, get remarried, have your first child or simply may want to add/remove someone from your will. It is important to keep your will updated with life changes as this could invalidate your Will.

 

Who Needs To Make A Will?

 

Basically, everyone needs to make a will. If are a married couple, co-habiting couples, civil partnerships, homeowners, if you have any children or have anything of any value or importance to you.

 

What Is Probate?

 

This is the process for ‘proving a Will’

 

It is the Executor’s responsibility to provide the Probate Registry with information requested by them. The Role of an executor does carry personal legal liability so we recommend on choosing a Professional Executor when it comes to dealing with a complex estate.
